A Richmond judge handed Dave Matthews Band violinist Boyd Tinsley a legal victory this morning, granting a motion to strike a series of salacious allegations from a lawsuit filed against him last week.

Richmond resident Andy Rothenberg, 41, who worked as a personal assistant for Tinsley, filed the lawsuit March 9 in Richmond Circuit Court.

Tinsley’s lawyers argued for nearly 40 minutes about why the claims, which focused on alleged molestation, sex with minors and drugging by Tinsley, should be dropped from the suit.

Tinsley’s lawyers said Rothenberg included the details in an attempt to embarrass Tinsley and draw media attention. They said his repeated attempts to secure a multimillion-dollar settlement in exchange for not filing the case amounted to attempted extortion.

Rothenberg, who pled guilty to wire fraud in 2013. He was sentenced to an 18-month term, served nine months in federal prison and is serving the rest under home confinement.

While the bulk of his lawsuit focused on Tinsley’s sexual history, his specific legal claim alleges that Tinsley soured a budding business relationship between Rothenberg and tennis star Andy Roddick.

Rothenberg represented himself at the hearing. While he attempted to read a prepared statement in court, the judge stopped him multiple times, asking him to instead specify what the sexual allegations had to do with the legal claims in his lawsuit.
