Many people intuitively believe that someone can waive his/her rights under employment regulations. They think that if an employee agrees to work without pay then there’s no longer a legal problem.
The truth is that most employment regulations are non-waivable. Any agreement between the employer and employee has no effect on the rights those laws confer. In this case, the relevant law is the federal Fair Labor Standards Act (FLSA) (and also potentially Virginia wage and hour laws). Those statutes expressly bar agreements to waive their protection. That means a volunteer could later choose to sue for unpaid wages or the Department of Labor could initiate an enforcement action despite the volunteers’ agreement to work without pay.
