We NEED this legislation. There isn't nearly enough intrusion by government into our lives. We know for a fact that this law will NEVER be misused. I'm curious if the phone service providers can say, "No, that doesn't sound like an emergency situation to me"? Warrants are issued when there is "proof" that certain "over the top" measures are required. Saying "someone was kidnapped" is not the same as "we have proof that someone was kidnapped". Since the main argument seems to be that "magistrates are not always accessible in some parts of the state", it seems to me that any crime that would require "emergency attention" has already risen to either a state of federal level of jurisdiction. So pass a bill that makes getting a warrant electronically easier. If I recall, kidnapping is a federal offense, so you would not obtain a warrant from a "local" magistrate anyway. Correct me if I'm wrong, since I do not know the law well enough to stand on that statement. I would think that if a federal law is broken, obtaining a warrant from another jurisdiction should not be an issue. If it is, then write a law to change that. The need to obtain a warrant probably came about to protect our rights from abusive government, and to re-enforce the 4th amendment concerning "unreasonable search and seizure".
