Update: Since Style posted this story, Agelasto sent a newsletter to his constituents that announced his resignation, calling the decision “extremely difficult” but necessary in the face of the costs of fighting legal action against him.

City Councilman Parker Agelasto has reached an agreement with Commonwealth’s Attorney Mike Herring to vacate his 5th district seat, effective Nov. 30, says a source close to the situation who asked not to be named.

Agelasto has been under fire for moving out of his district during his four-year term, which ends in 2020. Several Richmonders filed lawsuits to seek his ouster. City Attorney Allen Jackson has said that the charter was vague on residency requirements in this situation.

Around five months ago, Agelasto said that he had moved to a new, larger home in the 1st district to accommodate his family.

City Council is likely to request a special election to fill the remainder of his term. Interested candidates would need to collect signatures this summer and run for his seat in November.

By vacating in November, Agelasto will be able to vote on the budget that is set to be approved in May — and he could have a say in the $1.4 billion dollar coliseum proposal if it comes before November.
